CALIFORNIA PROP-65

Why you need to comply with California Prop-65

Safe Drinking Water and Toxic Enforcement Act of 1986 (California Prop-65), requires that exposure assessments be done on items (products) which may release chemicals known to the State of California to cause cancer and/or reproductive harm and if assessed exposures exceed the Safe Harbor Levels (No significant Risk Levels (NSRL) for carcinogen and/or the Maximum Allowed Dose Levels (MADLs) for reproductive toxins, then appropriate labels will be applied onto the products, to inform the public about the hazard.

What Is California Prop-65?

According to the Office of Environmental Health Hazard Assessment, California Environmental Protection Agency (OEHHA), Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986 was enacted as a ballot initiative in November 1986. The Proposition was intended by its authors to protect California citizens and the State's drinking water sources from chemicals known to cause cancer, birth defects or other reproductive harm, and to inform citizens about exposures to such chemicals. The Proposition 65 also requires the Governor of California to publish, at least annually, a list of chemicals known to the state to cause cancer or reproductive toxicity.

For additional information about the Proposition 65, please contact Cynthia Oshita or Susan Luong in the Proposition 65 office: (916)445-6900, or email Cynthia Oshita at coshita@oehha.ca.gov or email Susan Luong at sluong@oehha.ca.gov or visit OEHHA web at http://www.oehha.ca.gov.

What is Exposure Assessment?

Exposure assessment is a measurement or estimation of the magnitude, frequency, duration and route of exposure to a substance for the populations of interest. To assure compliance to California Prop-65, exposure assessment involves chemical(s) known to the State of California to cause cancer and/or reproductive harm, during intended use of the product. It involves a process of estimating or measuring the intensity, frequency, and duration of exposure to an agent. Ideally, it describes the sources, pathways, routes, magnitude, duration, and pattern of exposure; the characteristics of the populations exposed; and the uncertainties in the assessment.
